This statement explains how PlayerGames, LLC ("PlayerGames," "we," "us," or "our") processes data, where we operate, and our position on international data protection laws, including the EU General Data Protection Regulation ("GDPR"). It is provided for transparency, particularly for organizations evaluating our services. It is a statement of our practices and position — not an agreement — and it does not create rights or obligations beyond those in our Terms of Service and Privacy Policy.

1. Who We Are

PlayerGames, LLC is a United States limited liability company organized under the laws of the State of South Carolina. We have no establishment, subsidiaries, employees, or representatives in the European Union, the European Economic Area, or the United Kingdom.

All of our databases and core infrastructure are located in the United States. Personal information and account data are stored and processed exclusively in the United States.

2. Our Position on the GDPR

Our services are operated from the United States and are directed to the United States market. We price our services in US dollars and we do not advertise or direct our services to users in the EU, EEA, or UK.

Under Article 3(2) of the GDPR, the regulation reaches organizations outside the EU only in limited circumstances, such as where they envisage offering goods or services to data subjects in the EU. The mere accessibility of a website from the EU does not establish this (GDPR Recital 23). Because we do not envisage offering our services to EU data subjects, we take the position that the GDPR does not apply to our processing.

Individuals and organizations in the EU, EEA, or UK that choose to use our services do so on their own initiative, and on the understanding that their data will be transferred to, stored, and processed in the United States under our Terms of Service and Privacy Policy — not under the GDPR.

3. What We Do Not Offer

Consistent with the position above:

  • We do not enter into Data Processing Agreements (DPAs) or Standard Contractual Clauses (SCCs)
  • We do not act as a "processor" under GDPR Article 28 for any customer
  • We do not provide GDPR data subject rights, including the rights to erasure, portability, restriction of processing, or objection
  • We do not maintain an EU representative under GDPR Article 27

If your organization requires a GDPR-compliant processor, our services are not appropriate for processing EU personal data, and you should not submit EU personal data to them.

4. How We Handle Data

Independent of any particular regulation, we handle data carefully:

  • Processing location. All personal data is processed in the United States.
  • Security. We use industry-standard encryption for data in transit and at rest, access controls and authentication, security monitoring, and regular security updates and patches.
  • Service providers. We use US-based cloud infrastructure and hosting providers, third-party AI model providers (which process prompts, inputs, and related content to deliver generation features), error monitoring services, Stripe for payment processing, Google for advertising and analytics, and Klaviyo for email marketing.
  • What we collect and why is described in our Privacy Policy.

5. Security Incidents

If we discover a data breach affecting your personal information, we will investigate, contain, and remediate it, and we will notify affected users without undue delay, consistent with applicable US law.

6. Account Disabling, Retention, and AI Training

  • Account disabling. You may request that your account be disabled at any time by emailing [email protected]. Disabling ends your access to the services and stops future billing.
  • Retention. We retain data associated with accounts — including disabled accounts — as described in our Privacy Policy. We do not delete personal data except where required by applicable law.
  • AI training. Under our Terms of Service, users grant us a perpetual license to use content and data submitted to or generated through the services to train and improve our AI systems. This license survives account disabling or termination.

7. Governing Law

This statement, our Terms of Service, and our Privacy Policy are governed by the laws of the State of South Carolina, United States.
